COMMUNICATION SERVICES AND MATERIALS PROVIDED BY YOU



Use of Communication Services. The Web Site may contain news groups, forums, communities, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, “Communication Services”). You agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:



• Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
• Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.
• Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents. Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer.
• Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages.
• Conduct or forward surveys, contests, pyramid schemes or chain letters.
• Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner.
• Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
• Restrict or inhibit any other user from using and enjoying the Communication Services.
• Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.
• Harvest or otherwise collect information about others, including e-mail addresses, without their consent.
• Violate any applicable laws or regulations.

No Obligation To Monitor Communication Services. Company has no obligation to monitor the Communication Services. However, Company reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. Company also reserves the right in its sole discretion to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.



Limitation of Liability. Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. Company does not control or endorse the content, messages or information found in any Communication Service and, therefore, Company specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination, you are responsible for adhering to such limitations if you download the materials.



Right To Disclose Information Under Certain Circumstances. Company reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Company’s sole discretion.



Submissions Provided By You Not Confidential. You acknowledge that any materials or messages posted, files uploaded, data input or any other form of communication through the Web Site (“Submissions”) are not confidential and that such Submissions may be read or intercepted by others. You acknowledge that by submitting Submissions to the Web Site no confidential, fiduciary, contractually implied or other relationship is created between you and the Company other than pursuant to this Agreement.



License To Company In Submissions. By posting, uploading, inputting, providing or submitting your Submission you are granting Company, its affiliated companies and sublicensees the non-exclusive worldwide unrestricted cost and royalty-free license to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission and to publish your name in connection with your Submission, in connection with commercial or non-commercial endeavors. No compensation will be paid with respect to such use of your Submission, as provided herein. Company is under no obligation to post or use any Submission you may provide and Company may remove any Submission at any time in Company’s sole discretion.



Warranty & Representation. By posting, uploading, inputting, providing or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions and to grant to Company the right and license to copy, publicly display and otherwise exploit your Submission as more fully described in the preceding paragraph. You hereby waive all rights to any claim against the Company for any alleged or actual infringements of any proprietary rights, rights of privacy and publicity, moral rights and rights of attribution in connection with such Submissions. You further fully indemnify Company for any claims, conflicts or damages claimed by any third parties against Company that occurs or may occur as a result of your submissions.



RIGHT TO PUBLICITY



You understand that by attending the exhibition, you (including any minors attending the exhibition with you) may be filmed, photographed and/or otherwise recorded by SEE Global Entertainment and/or other ticket-holders attending the exhibition, and accordingly, you hereby irrevocably (i) agree that SEE Global Entertainment (or its designees) may film, photograph and otherwise record you, your voice, sounds, likeness, image, photograph and/or other picture (still or motion), performances, actions and appearances at the exhibition and/or around the venue of the exhibition (collectively, the “Recordings”), and (ii) grant SEE Global Entertainment a fully-paid, perpetual right to use your name, biographical information and the Recordings (no matter how any of the foregoing are depicted or portrayed) in connection with any programs, productions and/or other projects of SEE Global Entertainment (or its designees) in any manner in any and all languages, formats and media, whether now known or hereafter created, throughout the universe without restriction.



You (on behalf of yourself and any minor children for whom you are the parent and/or guardian) irrevocably waive any legal or equitable claims and remedies in connection with any use of the rights granted to SEE Global Entertainment herein, including, without limitation, any so-called “moral rights” or rights to equitable or injunctive relief. Accordingly, SEE Global Entertainment may edit, add to, subtract from, revise or otherwise change the Recordings in any manner (including interpolating and/or otherwise creating derivative works in combination with other materials of any kind or nature in any manner). You agree that, as between you and Lighthouse Imme, SEE Global Entertainment is the sole author and owner of all Recordings and all rights therein on a “work made for hire” basis as a contribution to a visual, audio and/or audiovisual work pursuant to the United States Copyright Act, as amended. SEE Global Entertainment is not obligated to exploit the rights granted herein.



You acknowledge and agree that SEE Global Entertainment has advised it cannot guarantee that persons in attendance will not take photos and/or video at or around the exhibition and cannot control such attendees’ use of such photos and/or video at or around the exhibition. Accordingly, you acknowledge and agree that you understand this risk by attending the exhibition and Company shall not be responsible or liable for any such activities.



YOUR ATTENDANCE CONSTITUTES CONSENT TO THESE TERMS AND CONDITIONS ON BEHALF OF YOU AND ANY MINOR CHILDREN FOR WHOM YOU ARE THE PARENT AND/OR GUARDIAN, AND IF YOU DO NOT WISH TO GIVE SUCH CONSENT, DO NOT ATTEND THE EXHIBITION.
